The Economic Impact of WOTUS Rule on Small Businesses
Using information gathered from the SBA Office of Advocacy, the Committee found that the Biden Administration’s new Revised Definition of Waters of the United States (WOTUS) will likely negatively impact an estimated 4,358,875 small businesses in the top three industries: Agriculture, Construction, and Manufacturing. These industries are most likely to be harmed because the new rule, which will be effective March 20, 2023, would create immense new costs and unnecessary uncertainty regarding land and building permitting. In some instances, it would also require private individuals to prove water on their land is not under the federal government's jurisdiction.
